DEFECTIVE PART WARRANTY PROCEDURE Cicli Esperia cover under warranty the frame and fork. In order to obtain a warranty repair or replacement, the purchaser has to take the defective part to a licensed Fondriest – Cicli Esperia SPA dealer, along with the original receipt with date of purchase. The warranty is valid only by following this procedure. Fondriest – Cicli Esperia spa is exempt from all responsibilities and obligations for any accident to persons or properties incurred during the use of the vehicle or any punitive damage suffered by the parties. The above mentioned warranty is deemed as the sole remedy of warranty and no other compensation is considered. The above mentioned warranty cannot be extended or otherwise changed by retailers, agents or Fondriest – Cicli Esperia SPA employees. Fondriest – Cicli Esperia SPA does not assume any responsibility or guarantees something different from what has been stated in the present warranty. CLAIMS To make a claim under this warranty, you must contact the dealer from whom the product was purchased. Repair or replacement of defective part(s) under warranty will be at the discretion of Fondriest-Cicli Esperia Spa and handled through the authorized Fondriest dealer. Please retain original receipt as proof of purchase. 1) Filled the form correctly with an ink pen 2) Original stamp or seal of the dealer 3) Mailing of the warranty within 10 days of the purchase of the complete bike or frameset 4) Possession of the original proof of purchase
EXCEPTIONS TO COVERAGE Fondriest-Cicli Esperia Spa does not warrant against malfunctions or failures that result from abuse, exposure to the elements, chemicals, internal or external rust, normal wear and tear, neglect, improper assembly, use of parts not consistent with intended use, accident, stunt riding, jumping, commercial use, or failure to follow instructions or warnings.
VOIDING OF WARRANTY This warranty will be void if any alterations or modifications, including the removal or application of paint, are made by anyone to the product without express written authorization of Fondriest-Cicli Esperia Spa.
LIMITATIONS OF THE WARRANTY The above mentioned warranty solely applies to the frame and fork. In the event of the purchase of complete bikes, the parts are subject to a one year warranty and to the terms and conditions of the parts manufacturer. The warranty is valid solely for normal and proper use of the bike. The improper use of the frame (acrobatic activities, stunting, jumping, riding on dirt road or any activities or hurdles not provided for in the specifications declared by the manufacturer) automatically cancels the above mentioned warranty. The warranty does not cover normal wear and tear or the defects and failures caused by negligence, insufficient maintenance, tampering, corrosion modifications or accidents. The warranty covers exclusively the replacement or repair of the defective parts. Labour and shipping costs are at the expense of the owner. The replacement or repair of defective parts will be free of charge and carried out under the discretion and decision of Fondriest – Cicli Esperia SPA. The defective parts must be checked at Fondriest – Cicli Esperia premises. If you feel that any bike purchased from Fondriest Star*Shop has developed a fault then please contact immediately the Fondriest Star*Shop you collected the bike from. This often saves time and freight costs if you contact the local Star*Shop as quite often the issue can be fixed without sending the bike back to Esperia Group. Returns Esperia Group will replace any goods if they are damaged/faulty on receipt. The purchaser must sight and confirm that they are happy and satisfied with the product before they leave the store. If there is a dispute regarding the product it must be addressed before the bicycle leaves the store and within 7 days of the shop receiving the bicycle. Freight Charges on returns are non refundable. If the product is damaged/faulty or incorrect product is supplied return freight and re-delivery freight will be paid by Esperia Group. If the product is being returned/replaced for a reason other than damage or faulty. The purchaser will be charged additional freight charges for both return to Esperia Group and re-delivery. Before returning any goods Esperia Group must be notified and approve reason for return. If the goods are out of stock Esperia group reserves the right to refund the value of the bike or replace the bike with another bike with the purchasers consent. This may be at additional cost to the purchaser if the model chosen by the consumer is of increased value. Esperia must be notified within 7 days of receipt and goods being returned must be:
Goods cannot be returned if the customer has changed their mind. Refunds and returns are only considered if the goods do not perform as advertised. No refunds or returns will be considered once the bicycle has left the store. Once the bicycle has left the store it becomes subject to our warranty conditions.
